The short version. You must be 13 or older. What you post stays yours; you let us show it on faxa. If you upload music as an artist, you confirm you own or control the rights to it. Don't post things that break the law or our Community Guidelines. We can remove content and close accounts that do.
1. Who we are
faxa ("faxa", "we", "us") is operated by [Company legal name], a company registered in Brazil under CNPJ [CNPJ], with its address at [Registered address]. These Terms apply to the faxa app, the website at faxa.app and any related service (together, the "Service").
By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
2. Who can use faxa
- You must be at least 13 years old. We ask for your year of birth at sign-up to check this.
- If you are under the age of majority where you live (18 in Brazil), you confirm that a parent or legal guardian has agreed to these Terms with you.
- You can't use faxa if we previously closed your account for breaking these Terms, unless we say otherwise.
3. Your account
- Give accurate information and keep your email up to date. You can correct your details in Settings.
- You are responsible for what happens on your account. Keep your password private and tell us at support@faxa.app if you think someone else got in.
- Usernames that impersonate someone, mislead people or infringe trademarks can be changed or reclaimed.
- Connecting Spotify is optional. If you connect it, Spotify's own terms also apply to that connection.
4. Your content
"Your content" is anything you post: logs, ratings, reviews, lists, posts, comments, community and event discussions, profile details and, for artists, releases, audio previews and images.
- You keep ownership. faxa doesn't claim ownership of your content.
- Licence to display. You give faxa a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, resize an image or transcode audio), display and distribute your content only as needed to run, show and promote the Service, following the visibility you choose. For audio previews this means streaming them to the people your settings allow (private, link or public); we don't sell your music or offer it for download.
- The licence ends when you delete the content or your account, except for copies other users already saved through features you used (for example, a comment in someone else's thread), backups kept for a limited time, and what we must keep by law.
- You are responsible for your content and confirm you have the right to post it.
5. Artists and uploads
When you claim an artist page or upload audio, artwork or other images, you confirm that:
- You own or control all the rights needed to upload and share that material on faxa, including rights in the recording, the composition and the artwork, and any permission from bandmates, labels, publishers, distributors or collecting societies.
- Your upload doesn't infringe anyone's copyright, trademark, privacy, publicity or other rights.
- You are authorised to act for the artist page you manage, and you'll remove team members who should no longer have access.
You will defend and indemnify faxa against third-party claims caused by material you uploaded in breach of these promises, to the extent allowed by law. Copyright notices are handled under our Copyright policy; content can go offline as soon as a valid notice arrives.
6. What's not allowed
The full list is in the Community Guidelines. In short, don't:
- Upload or link music, artwork or other material you don't have the rights to.
- Harass, threaten, or promote hate or violence against people or groups.
- Post sexual content involving minors, sexually explicit content, or content that exploits anyone.
- Impersonate artists, people or organisations, or claim an artist page that isn't yours.
- Spam, manipulate ratings, setlist polls, charts or follower counts, or create fake accounts or RSVPs.
- Share someone's private information without permission.
- Scrape, reverse engineer, overload or try to break the Service or its security, or get around rate limits or blocks.
- Use faxa for anything illegal.
7. How we enforce
- We can remove or limit content, disable previews, suspend artist pages and suspend or close accounts that break these Terms or the Guidelines, or when the law requires it.
- Where it's reasonable and safe, we tell you what we did and why, and you can reply to ask us to look again at support@faxa.app.
- Repeat infringers. When three copyright notices against an artist page are upheld, that page is suspended. We may also close accounts that repeatedly infringe.
- Anyone can report content in the app. False or abusive reports can lead to action against the reporter.
8. Events and third parties
Events created on faxa (RSVPs, lineups, after-parties, setlist polls) are organised by their organisers, not by faxa, unless we say so. A setlist poll is a suggestion to the artist, not a promise of what will be played. Tickets, venues and some event listings come from third parties such as Ticketmaster; links to Spotify, Ticketmaster, maps and other services take you to their sites, under their own terms.
9. The Service
- faxa is free to use today. If we introduce paid features, we'll show the price and terms before you pay.
- We keep improving faxa, so features can change or go away. If a change materially affects you, we'll try to give notice in the app.
- You can't use faxa's name, logo or design without our written permission.
10. Ending your account
You can delete your account at any time in Settings → Delete account. We can suspend or close your account if you seriously or repeatedly break these Terms, if the law requires it, or if your account creates risk for others. Sections 4 (for content already shared as described), 5, 11, 12 and 13 survive the end of your account.
11. Disclaimers
We work hard to keep faxa running and safe, but the Service is provided "as is" and "as available". To the extent allowed by law, we don't guarantee that it will be uninterrupted or error-free, or that content posted by users, artists or third-party services (metadata, artwork, event listings) is accurate. Nothing in these Terms limits rights you have as a consumer under the law that applies to you, including the Brazilian Consumer Defence Code (Lei 8.078/1990).
12. Limitation of liability
To the extent allowed by law, faxa isn't liable for indirect or consequential losses, lost profits or lost data, or for content and conduct of other users and third parties. Where liability can't be excluded, it is limited to the greater of the amount you paid us in the 12 months before the claim or [amount, e.g. BRL 500]. This doesn't limit liability for wilful misconduct, gross negligence or anything that can't be limited by law.
13. Governing law and disputes
These Terms are governed by the laws of the Federative Republic of Brazil. Disputes go to the courts of[City / State], Brazil, except where the law gives you the right to bring a claim in the courts where you live (for example, as a consumer in Brazil or in the European Union). Before going to court, please write to us at support@faxa.app; most problems can be solved there.
14. Changes
We may update these Terms. If a change is material, we'll tell you in the app or by email before it takes effect. The date at the top shows the latest version. If you keep using faxa after the change, the new Terms apply.
